HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.23762 of 2017 ORDER:

The petitioners pray for the following relief: " ....writ of mandamus declaring the action of 3rd respondent in entertaining ROR Appeal No.E/ 157/ 2017 at the instance of the 5th respondent under the provisions of A.P. Record of Rights in Land and Pattadar Pass Books Act, 1971, ten years after the petitioners names have been mutated in the revenue records and pattadar pass books and title deeds have been given to them in respect of agricultural lands in an extent of Ac.2.31 Gts: Ac.0.31 Gts; Ac.0.32; Ac.0.31 in Sy.No.286 and Ac.3.20 Gts in St.No.285/ A respectively situated at Venkatapuram (V)& (M), Jayashankar Bhupalapalli District, as illegal, without jurisdiction & authority and consequently set aside the ROR Appeal No.E/ 157/ 2017 pending on the file of the 3rd respondent herein."

2. With the assistance of Mr. Jithender Rao Veeramalla, I have perused the annexures on which the petitioners are relying upon. After hearing the counsel and perusing the documents, this court is of the view that the petitioners ought not to doubt the jurisdiction, discretion and competence of 3rd respondent in adverting to the material available on record including objections raised by petitioners and pass orders in accordance with law. The petitioners, for any reason, if are aggrieved by the out come, can certainly take advantage of commissions and omissions conducted by 3rd respondent to work out their grievances or protect their rights. It appears this court is of the view that the writ prayer is more in the nature of a preventive relief and no case is made out for considering, since the subject matter is pending before the 3rd respondent.

3. The writ petition is disposed of as indicated above. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
