HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN and HON'BLE SRI JUSTICE U. DURGA PRASAD RAO WRIT APPEAL No.806 of 2016 and WRIT PETITION No.26713 of 2016 COMMON JUDGMENT : (Per HACJ) Sri C.Suman, learned counsel for the respondent/writ petitioner, on instructions, would fairly state that, since the writ petitioner has secured admission in DM (Cardiology) at Andhra Medical College, Visakhapatnam, he does not wish to deprive the appellant of a seat in DM (Cardiology) at Sri Venkateswara Institute of Medical Sciences, Tirupathi, though, according to him, the Clause prescribed in the prospectus is arbitrary and in violation of Article 14 of Constitution of India.

Sri Vedula Venkataramana, learned Senior Counsel appearing on behalf of the appellant, on instructions, requests this Court to place on record the appellant's acknowledgement of the graceful act on the part of the respondent-writ petitioner. Sri C.Suman, learned counsel for the respondent-writ petitioner, seek permission of this Court to withdraw the writ petition itself. W.P.No.26713 of 2016 is, accordingly, dismissed as withdrawn. W.A.No.806 of 2016 is disposed of accordingly. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
