HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.18994 of 2006 ORDER:

Heard Mr.G.L.Narasimha Rao for petitioner and the Assistant Government Pleader for respondents 1 to 5. No representation for 6th respondent.

The petitioner prays for Mandamus declaring the action of respondents 1 to 5 particularly 1st respondent in not including the name of petitioner as one of the legal heirs or successors-ininterest of late Pathan Munwar Khan along with 6th respondent as illegal and unconstitutional.

The disputes referred in the writ petition relate to succession to the estate of late Pathan Munwar Khan. The 6th respondent claims to be his wife and solely entitled to represent the estate has obtained the Certificate from 1st respondent. This Court is of the view that the Certificate even if granted has limited purpose and scope and the same will not be treated as adjudication on the right of petitioner. The petitioner, if so advised, can institute proceedings before Civil Court for comprehensive reliefs.

The prayer as made, particularly, having regard to the stand taken in the counter affidavit, is not entertained.

With the above observation, the writ petition is accordingly dismissed. No order as to costs.
