THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.8613 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents 1 to 4 in not implementing the orders passed in O.A.Nos.68 and 69 of 1995, dated 20.04.2001 by the third respondent and also in allowing the encroachers, i.e. respondents 5 and 6 in the petitioner temple Mulgies bearing Nos.15-6-148 and 15-6-149 situated at Kolsawadi, Begum Bazar, Hyderabad as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader representing the respondents 1 to 4 and learned counsel for respondents 5 and 6.

A perusal of the record reveals that feeling aggrieved by the orders dated 20.04.2001 passed by the third respondent in O.A.Nos.68 and 69 of 1995, respondents 5 and 6 filed Revision Petitions No.21 and 22 of 2001 before the Regional Joint Commissioner, M.Z-II, Hyderabad. Learned Joint Commissioner dismissed the Revision Petitions on 06.03.2003 while confirming the orders in O.A.Nos.68 and 69 of 1995. After disposal of the revision petitions, the Government issued G.O.Rt.No.371 Revenue (Endowment.II) Department, dated 22.08.2016.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the fourth respondent to take appropriate steps in pursuance of G.O.Rt.No.371 Revenue (Endowment-II) Department, dated 22.08.2016.

In view of the submission made by both the counsel, this Court is not inclined to express any opinion with regard to the merits of the main case.

Having regard to the facts and circumstances of the case, the fourth respondent is hereby directed to take steps in pursuance of G.O.Rt.No.371 Revenue (Endowment-II) Department, dated 22.08.2016, as expeditiously as possible, preferably, within a period of two (2) months from the date of receipt of copy of this order.

With the above direction, writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
