HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.2459 OF 2012 ORDER:

The effort of revision petitioners through EA.No.202 of 2012 to summon Sub-Registrar, Cumbum, to produce the record relating to registered Will Deed dated 12.09.1952 is rejected by the Executing Court. Hence, the CRP.

Mr.Seshagiri Rao after making a few submissions on merits submits that the entire effort of revision petitioners is to bring on record the alleged Will dated 12.09.1952 on record in support of the objections they have raised in the other application pending before the Executing Court. The revision petitioners are prepared now to get copy of registered extract and file before the Executing Court. He does not seriously challenge the findings recorded by the Executing Court.

Mr. Ravi does not oppose the alternative submission made by the revision petitioners, for the respondents would have opportunity to take all objections available in this behalf as and when such document is produced before the Executing Court. In view of the above, by granting liberty as prayed for, the revision is dismissed. The Executing Court considers and disposes of the E.P. as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order. No order as to costs.
