HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9746 of 2015 ORDER :

This Criminal Petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in F.I.R.No.128 of 2014 of Cyber Crime Police Station, Hyderabad District.

Heard the learned counsel for the petitioner/accused and also the learned Public Prosecutor for the State before admission and before notice to the 2nd respondent/de-facto complainant.

Perused the material on record including order granting bail to the petitioner covered by Crl.P.No.8295 of 2014, order regarding taking of passport covered by Crl.P.No.5037 of 2015, F.I.R. and other material including list of articles seized by police total twenty one(21) in number. The crime was registered and investigation was pending since June, 2014 is not in dispute. The investigation is not even completed.

It is the submission that the seized properties are damaging in the hands of police and it requires a direction to the articles either to keep in safe custody or produce before the Court or to return those that are no way required to the investigation.

In fact, a perusal of the material falls short to quash the F.I.R. but for to say while disposal a direction can be given to the police concerned to complete the investigation and file final report and submit whatever the relevant case property to claim any return there from and that is not relevant for investigation to return from whom it seized from authenticity and acknowledgement.

Accordingly, this criminal petition is disposed of directing the police concerned, who is investigating case to complete the investigation within two months from

the date of receipt of a copy of this order.
