This writ petition was filed challenging the action of the 2nd respondent in not granting ratification of students admitted by the petitioner, and the 3rd respondent not granting affiliation to the petitioner college for the academic year 2014-15. As per the averments pleaded in the affidavit filed in support of the writ petition, the petitioner-institution submitted application for grant of recognition for B.Ed course for the academic year 2014-15 to the National Council for Teacher Education (NCTE). The NCTE granted formal recognition vide proceedings dated 30.03.2015 for the academic year 2014-15. The 3rd respondent-university, after verifying the qualification of the staff recruited by the petitioner-institution, granted staff approval by proceedings dated 28.02.2015.

Thereafter the 3rd respondent received the amount towards processing the new college and affiliation for 2014-15. Thereafter the petitioner-institution submitted a representation to the State Government for issuance of G.O basing on the formal recognition granted by the NCTE. But by that time half of the academic year was completed. The petitioner submitted the list to the 2nd respondent on 16.07.2015 for approval and for ratification of the students and to the 3rd respondent to receive the examination fee. When no action was taken by the 2nd and 3rd respondents the present writ petition is filed as stated supra. The material placed on record would show that the last date prescribed by the 2nd respondent was 30.11.

of approved candidates. But the list was submitted by the petitioner in respect of the convener quota as well as the management quota only on 16.07.2015. Though when the NCTE granted recognition on 30.03.2015 for the academic year 2014-15 only and the 3rd respondent has not granted any affiliation as on today, it is not known under what circumstances the petitioner admitted the students. Further, the petitioner approached this Court five days before commencement of examinations. In view of the same, in the absence of any affiliation by the 3rd respondent and approval of list by the 2nd respondent, this Court is not inclined to grant any relief in this writ petition. Accordingly the writ petition is dismissed. As a sequel, miscellaneous petitions, if any, shall stand closed. No order as to costs.
