THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12300 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused No.2 in Crime No.169 of 2025 of Prohibition & Excise Station, Saroornagar, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 07-08-2025 about 6:00 a.m., the Prohibition & Excise Officers, Saroornagar, stopped Accused No.1 at Etlapur X Road. Upon search of the bags in his possession, packets containing ganja weighing a total of 11.543 kg were allegedly found and weighed in the presence of panch witnesses. The accused persons reportedly stated that they purchased the said contraband from accused No.3 and were transporting it for sale. Two mobile phones and a two-wheeler were seized along with the contraband, which was sealed, labeled, and taken into custody. The accused were informed of the offence under the NDPS Act and were arrested for the offence punishable under Section 8(c) r/w section 20 (b)(ii)(B) of the NDPS Act, 1985.

Heard Sri L. Sai Kumar Yadav, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner herein is in jail from 07.08.2025 and the seized quantity of the ganja is 11.543 kg, which is an intermediate quantity. It is further submitted that the petitioner herein is a woman and mother of two minor children. It is further submitted that the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that there are no other cases pending against the petitioner herein. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record,

it appears that the petitioner herein is in jail from 07.08.2025 and the seized quantity of the ganja is 11.543 kg, which is an intermediate quantity and the material part of the investigation was already completed. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions.

i.

The petitioner/ accused No.2 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIII Additional District and Sessions Judge, Cyberabad, Ranga Reddy District, at L.B. Nagar.

ii.

The petitioner/ accused No.2 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for

the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/ accused No.2 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
