- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.201 OF 2017 ORDER :

Petitioners challenge the order of cancelling the notional increments earlier granted, revision of increments and recovery of arrears amount paid towards notional increments in W.P.No.37252 of 2015 & batch. The writ petition was allowed holding the proceedings as illegal. Alleging that the said order is violated, this contempt case is filed.

The averments made in the affidavit filed in support of this contempt is not clear as to whether the respondents have released the increments by computing the notional increments granted to them. But vague allegation of violation of direction is made. 3.

Para No. 6 of the counter affidavit filed on behalf of the respondents read as follows :

"It is respectfully submitted that the Respondents have not taken any steps to make any recovery of amounts from the Petitioners after the writ petitions were disposed off on 24.11.2015. The notional increments which were granted to the Petitioners for the period 2007 to 2009 are being continued and the pay of the petitioners has not been reduced. Therefore, the respondents have not committed any violation of the orders of the Hon'ble Court."

This statement of the respondents would clearly show that the petitioners continued to draw the increments as was paid to them earlier to the impugned order. I therefore, do not see any violation of the directions issued by this Court, warranting continuation of proceedings under the Contempt of Courts Act.

Having regard to the above, the Contempt case is closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
