THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No. 3738 OF 2016 ORDER:

This Civil Revision Petition is filed by the respondents/ defendants aggrieved by the exparte interim injunction granted by the learned SubDivisional Magistrate and Special Assistant Agent to Government, Mobile Court, Bhadrachalam, Khammam District, dated 09.02.2016 in I.A. No.46 of 2016 in O.S. No.57 of 2016.

2. At the stage of admission, the C.R.P. is disposed of with the consent of Sri P.V.Krishnamachary, leaned counsel for revision petitioners. He submitted that revision petitioners have filed counter in I.A. No.46 of 2016 and the matter is not yet heard by the trial Court. Since the order passed by the trial Court is an exparte order and the respondents/ defendants, who are revision petitioners, have already filed counter challenging I.A. No.46 of 2016, it is apposite to direct the trial Court to dispose of I.A. No.46 of 2016 on merits, at the earliest.

3. Accordingly, the trial Court is directed to hear both sides and pass appropriate orders on merits in I.A. No.46 of 2016 in O.S. No.57 of 2016 within a period of two months from the date of receipt of the copy of this order.

4. This C.R.P is accordingly, disposed of. No costs.

5. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
