THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.12039 of 2025 ORDER:
The present Criminal Petition is filed praying this Court to grant pre arrest bail to the petitioner who is arrayed as accused No.1 in Crime No.508 of 2025 before the Ameenpur Police Station, Sangareddy District, registered for the offences punishable under Sections 69, 88, 351(2) and 79 of BNS. 2.
The brief facts of the case are that the first informant, aged about 23 years and employed with Amazon, has been residing at H.No.1-161, near Siddhi Sai Baba Temple, Ameenpur, since 2023 in a rented house belonging to her sister's daughter. She became acquainted with the petitioner, a police constable at Chandrayangutta Police Station, through Instagram in 2022, and they began communicating via WhatsApp. In 2023, the petitioner allegedly expressed his love, which the informant reciprocated, and they met frequently between 2023 and 2025. The petitioner is alleged to have had sexual intercourse with the informant at her residence and again on 21.04.2025 at OYO Rooms, Miyapur X Road, where
he reiterated his intention to marry her. On 10.05.2025, the informant tested positive for pregnancy and informed the petitioner, who stated that they should wait 5-6 months before marrying and subsequently provided her with tablets on 14.05.2025 to terminate the pregnancy. Upon her request for marriage, the petitioner refused. A panchayat was held between both families, during which Ravi Kumar (A-2) allegedly assaulted and threatened the informant, while M. Venkatappa (A-3) and Kotla Hanumanthulu (A-4) claimed to have hacked her mobile data and coerced her to accept money and withdraw, failing which she would face dire consequences.

Learned counsel for petitioner submitted that the petitioner is innocent and has been falsely implicated in the present case, which arises out of a failed panchayat between both families. He further submitted that the petitioner, aged about 23 years and working as a civil police constable at
Chandrayangutta Police Station, was in a consensual relationship with the first informant, an educated woman employed in an international company since 2022, and both hail from Mamidikunta Village, Daulathabad Mandal, Vikarabad. He asserted that the complaint, dated 02.09.2025, was lodged after an inordinate delay of nearly four months from the date the informant tested positive for pregnancy on 10.05.2025. He averred that the petitioner never induced the informant by deceitful means as defined under Section 69 of BNS and had genuine intentions to marry her, which were thwarted due to familial disputes.

Learned counsel for petitioner incessantly contended that none of the alleged offences, except Section 69 BNS, attract punishment exceeding seven years, and even Section 69 is not applicable in the absence of initial fraudulent intent. While advocating that the petitioner is a public servant with no likelihood of absconding, and if arrested, he would suffer irreparable harm including loss of employment, he prayed this Court to grant anticipatory bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for petitioner stating that the allegations leveled against the petitioner are of serious nature. Therefore, prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made and on going through the material placed on record, it is noted that the relationship between the petitioner and complainant started from the year 2022 and the alleged incident occurred in the month of May 2025, including the abortion, but no such report was lodged before the Police. However, only after failure of panchayat, the report was lodged. That apart, learned counsel for petitioner also submitted that the matter between the parties is already compromised. Considering all the aspects, this Court deems it fit to grant pre-arrest bail to petitioner, subject to compliance of the following conditions: i.
The petitioner shall surrender before the Station House Officer, Ameenpur Police Station, Sangareddy District, within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on him
executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday, and Friday, between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
