Ravula Swathi v. The State Of Telangana, Rep. By Its Principal Secretary,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.1444 of 2017 ORDER:
This writ petition is filed to declare the action of the 4th respondent in interfering with the peaceful possession of the petitioner's function hall situated in Sy.No.1101 of Alair Village and Mandal, Yadadri Bhongir District as illegal and arbitrary.
It is stated in the affidavit that the petitioner has already filed O.S.No.77 of 2016 on the file of Junior Civil Judge, Alair against the 4th respondent for grant of injunction. For the same relief, again the petitioner has approached this Court by way of filing the present writ petition. The petitioner cannot simultaneously avail two remedies i.e. one by way of filing civil suit, another by way of filing writ petition, instead of pursuing the civil suit. In view of the same, I do not see any reason to entertain the present writ petition and the same is accordingly dismissed.
As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 27-01-2017 Nvl
