Petitioner applied to the post of Prohibition and Excise Constable in pursuant to the notification No.6/2016. According to petitioner, he is the native of Hyderabad district, studied upto 6th class in Hyderabad. The same school where he studied was shifted to Attapur, which is forming part of Ranga Reddy District, where petitioner continued to study in the same school upto 10th class. Thereafter, he prosecuted his further study in Hyderabad. Petitioner has been living in Hyderabad all along. While so, in the selections conducted in pursuant to the Notification No.6/2016, petitioner was treated as non-local of Hyderabad and as local of Ranga Reddy district and he was not selected for the post earmarked for the local candidates. Earlier petitioner made representation. By the order impugned, request of petitioner was rejected on the ground that he has not secured merit in Ranga Reddy district as local candidate of Ranga Reddy district. 2.

Admittedly, petitioner prosecuted his education from 7th class to 10th class in Ranga Reddy district. A person can be treated as local candidate of a particular district if he has studied in an educational institution in such local area for a period not less than four consecutive academic years ending with the academic year in which the candidate appeared first for the relevant qualifying examination. As per the A.P.Public Employment (Organization of Local Cadres and Regulation of Direct Recruitment) Order 1975, relevant qualifying examination is SSC. Thus, a candidate has to be treated as local candidate of a

particular district if such candidate has studied in four consecutive academic years in educational institutions of that local area leading to write 'X' Class examination. In the instant case, admittedly, petitioner had studied from 7th class to 10th class in Attapur in Ranga Reddy district and, therefore, petitioner has to be treated as local candidate of Ranga Reddy district. The residence has no relevance for the purpose of determining the status of local candidate if such candidate has studied in a local area in four consecutive academic years leading to write 'X' Class examination. Therefore, merely because petitioner claims to be residing in Hyderabad, he cannot claim to be treated as local candidate of Hyderabad. Thus, I see no error in the decision rejecting the request of petitioner for consideration for employment. Writ Petition merits no consideration and it is accordingly dismissed.
