Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies representing the respondents from instructions and perused the prayer in the writ petition with supporting affidavit.
Undisputedly, the petitioner's father K. Kondaiah was the dealer of Fair Price Shop No.47 of Venkateswarapuram, H/o.Bommireddipally, Kanigiri Mandal, Prakasam District and on the allegations of irregularities there was a departmental enquiry by the competent authority-cumRevenue Divisional Officer and found fault with and impugning the adverse order said Kondaiah filed appeal before the Collector (CS) and during the pendency of the appeal he breathed the lost. The petitioner made a representation in place of his father to represent the case of his father of no irregularities and sought permission that was not accorded. It is the substance of the grievance in the writ petition.
As the irregularity or not which is the subject matter of appeal since the person who impugned and maintained the appeal breathed the lost and his son want to represent the case to demonstrate that there is no irregularity, the Collector
(CS) shall permit by virtue of this order to represent. However, it is made clear that this order will not entitle any right to claim compassionate appointment but for on own grounds if at all entitled for by any specific provision and procedure. The writ petition is disposed of accordingly. There shall be no order as to costs.
The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
