THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE DR. JUSTICE SHAMEEM AKTHER W.P.NO.20892 OF 2017 O R D E R (Per the Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed for the following relief: "For a writ of Mandamus declaring the orders of the Hon'ble Tribunal in O.A.No.4882 of 2013 dated 10-04-2017 dismissing the O.A., along with O.A.No.5136 of and batch and impugned C.No.169/A1/2011, D.O.No.651/2013 dated 21.6.2013 issued by the 1st respondent as illegal, arbitrary, unconstitutional and violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents not to bifurcate the Police Executive Force into two separate units i.e.

, Guntur Urban and Guntur Rural and also hold that the petitioners are entitled to be continued at their respective places with all consequential benefits and pass such other order or orders as this court may deem fit and proper in the circumstances of the case." The main grievance of the petitioners is that they were being allotted to Guntur Rural from Guntur Urban without considering their seniority and calling for the options.

Learned Government Pleader appearing for the respondents, on instructions, would submit that the respondents have decided to call for the options from the petitioners and, further, she has assured to this court that the seniority will be maintained in the ongoing bifurcation of the Police Executive Force into two separate units i.e., Guntur Urban and Guntur Rural.

Recording the statement made by learned Government Pleader appearing on behalf the respondents, the order dated 10.04.2017 passed in O.A.No.4882/2013, is hereby set aside. Accordingly the respondents are directed to call for the options of the petitioners duly following the seniority in the bifurcation process.

With the above observations, the writ petition is disposed of. No order as to costs.
