Bhosale) Hear d Mr.M.V.Pratap Kumar, learned counsel holding for Mr.M.V.S.Suresh Kumar, Advocate on record for the appellants; learned Government Pleader for Revenue for respondent Nos.1 to 3; Mr.Mahadeva, learned counsel holding for Mr.K.G.Krishna Murthy, Advocate on record for respondent No.4 and Mr.V.V.Narasimha Rao, learned counsel for respondent Nos.116 to 136. Learned counsel for the appellants submits that the appellants would be satisfied if it is observed that the civil Court should decide the reference under Section 30 of the Land Acquisition Act, 1894 (for short 'the Act') on merits in accordance with law and uninfluenced by the observations made in the instant proceedings. Learned counsel appearing for the respondents have no objection for making such observation.

Hence, we dispose of this appeal observing that the civil Court shall decide the reference under Section 30 of the Act on merits in accordance with law and uninfluenced by the observations made in these proceedings.

Consequently, miscellaneous petitions, if any, also stand disposed of.
