THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.8883 OF 2006 ORDER:

This writ petition is filed seeking a writ of mandamus declaring the inaction on the part of the official respondents in demarcating the land in Sy.No.201/3 to an extent of Ac.0.7 1⁄2 cents, situated at Tadepalli village as per the requisition and the challan paid towards demarcation under the provisions of the Survey and Boundaries Act as arbitrary and illegal.

Considering the nature of grievance of the petitioners, it is suffice if a direction is given to the official respondents for the conduct of the survey of the subject-land, if the petitioners comply with all the necessary prescribed formalities to have such survey conducted. Accordingly, the writ petition is disposed of directing the official respondents to consider the application of the petitioners and after complying with all the necessary prescribed formalities by the petitioners, shall conduct the survey of the subject-land with due notice to the parties concerned and demarcate the boundaries with metes and bounds, as expeditiously as possible, at any rate, within a period of three months from the date of receipt of a copy of this order and the result of the survey be communicated to the petitioners. No costs.

As a sequel, pending miscellaneous applications shall stand closed.
