The order impugned in the revision declined the prayer of revision petitioner herein to receive the compensation awarded to K. Ajad since deceased/ petitioner No.2 in MVOP.No.220 of 2013. 2.

The case of Mr. K. Prasad Rao/ revision petitioner is that he and his wife were arrayed as respondents 3 and 4 in MVOP.No.220 of 2013. MVOP was filed by one K. Sandhya, second wife of the deceased K. Chandra and K. Ajad, son of Late K. Chandra. The case of K. Prasad Rao is that one K. Mariamma (first wife of Late K. Chandra) predeceased K. Ajad and K. Prasad Rao and K. Sugunamma, being Class I heirs are entitled to receive the compensation. The tribunal apportioned the compensation to petitioners 1 and 2 in MVOP and respondents 3 and 4 therein.

I have referred to the submissions made in this Court for the limited purpose of drawing the attention of the tribunal to consider the objections of the parties, apply its mind to the prayer made therein, verify the cause title in MVOP.No.220 of 2013 and pass a speaking order as the circumstances warrant. The order impugned in the revision is set aside. The matter is remitted to tribunal and the tribunal is directed to dispose of the application within two (2) weeks from the date of receipt of copy of this order.

The civil revision petition is allowed and remanded. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
