THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12038 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused in FIR No.1858 of 2025 of Gachibowli Police Station, Cyberabad Commissionerate, on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 21.08.2025, the de-facto complainant lodged a report before the police stating that the de-facto complainant has been working as a Nurse for the past 4 years at Mallareddy Hospital, Suraram. During the year 2023, the accused developed acquaintance with her, expressed his love towards her, and promised to marry her. Believing his words, the de-facto complainant accepted his love proposal. The de-facto complainant further stated that in the month of November 2024, the accused established physical relations with her. Thereafter, on several occasions, he continued to have sexual relations with her on the pretext of marriage. The de-facto complainant further stated that, for the last two months, her menstrual cycle has stopped and when she asked him to marry her at the earliest, he avoided her, switched off his mobile phone, and absconded. Basing on

the said complaint, the police registered a case in Crime No.1858 of 2025 for the offence punishable under Section 69 of BNS.

Heard Sri Baglekar Akash Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner herein was arrested on 31.08.2025 and was remanded to the judicial custody for 14 days. It is further submitted that the petitioner is innocent and has been falsely implicated in the alleged offence. It is further submitted that, even after lodging of the report before the police, a compromise was entered into between the parties and the defacto complainant agreed to withdraw the same and the material part of the investigation was already completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the

petitioner are serious in nature and there is no such compromise entered into between the parties. Further, the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that a complaint is lodged before the police by the de-facto complainant itself shows that they were in physical relationship from the year 2024 and the de-facto complainant lodged a report in the year 2025, when the petitioner refused to marry her and the material part of the investigation was already completed. Further, as seen from the record, LWs 1 to 10 witnesses were already examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions.

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the

learned II Additional Junior Civil Judge-Cum-X Additional Judicial Magistrate of First Class, Ranga Reddy District, at Kukatpally.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
