HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No. 20341 of 2014 O R D E R:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of respondents in trying to demolish the structures of the petitioner's building bearing D.No.14/89 situated in Sy.No.923, Getukadapalli, Galiveedu Mandal, Kadapa District, without following due process of law as illegal and arbitrary. Petitioner's case briefly, is that he purchased RCC building constructed in an extent of 117 sq.yds bearing D.No.14/89 situated in Sy.No.923 of Getukadapalli, Galiveedu Mandal, Kadapa District, through a registered sale deed dated 10.11.2011 vide Document No.2899/2011 and since then, he has been living in the said house by paying taxes to the Government regularly. His house is situated on Kadiri to Rayachoti road. While so, on 07.07.12014, respondent No.4 along with officials of respondent No.

3 came to his house and marked the portion of the land on the pretext that the land is required for road widening since it is a Government land. On 14.07.2014, again respondent authorities came to the subject property and directed the petitioner to vacate the premises as they are going to demolish part of the structures of the house.

Questioning the illegal action of respondent authorities, the present writ petition is filed.

Heard.

Learned Government Pleader for Revenue takes notice on behalf of respondents and no counter is filed so far. Having regard to the relief sought by the petitioner, this Court deems it appropriate to direct respondent authorities to follow due process of law while acquiring the petitioner's subject property and demolishing the structures thereon, for the purpose of road widening.

With the above direction, the writ petition is disposed of. No costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
