THE HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CMP. No.710 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1051 of 2014 from Family Court, Ranga Reddy District and transfer the same to Family Court, Warangal.

2. Wife filed this application and according to her affidavit her marriage with respondent was performed on 13.02.2009 and, due to harassment, she is living separately at her senior paternal uncle's house. She stated that respondent - husband filed O.P. before the Family Court, Ranga Reddy for divorce and it is difficult for her to travel from Nagaram Village of Parkal Mandal, Warangal District to Ranga Reddy District for defending O.P. filed by her husband. It is stated that distance between two places is about 175 K.Ms. She stated that she being a lady, she cannot travel without assistance of a male person and she has no male assistance to escort her. She further stated that she has no income to meet travel expenses, in order to maintain herself, presently she is undergoing training in tailoring and embroidery in the village of her senior paternal uncle, who is also a aged person. For these reasons, she prayed for transfer of O.P. from Family Court, Ranga Reddy District to Family Court, Warangal.

3. Husband filed counter disputing the affidavit averments of petitioner and opposed transfer of petition contending that this petition is an afterthought only after failure of attempts for resolving the disputes amicably.

4. Heard arguments and perused the material papers filed along with Tr.CMP and also counter affidavit.

5. The entire counter affidavit is with regard to disputes in divorce O.P. and there is no tenable objection raised in counter for withdrawing O.P. from Family Court, Ranga Reddy. Therefore, considering the convenience of wife and financial status of wife, I feel that her request for transfer can be considered.

6. Accordingly, O.P.No.1051 of 2014 is withdrawn from Family Court, Ranga Reddy District and transferred to Family Court, Warangal, for disposal in accordance with law.

7. The petition is, accordingly, ordered. No order as to costs.

8. As a sequel, miscellaneous petitions pending, if any, shall stand disposed of.
