This petition is filed under Section 24 of CPC seeking to withdraw F.C.O.P.No.397 of 2015 pending on the file of the Family Court, Ranga Reddy District at L.B. Nagar and transfer the same to the Family Court-cumAdditional District Judge, Tirupati. 2 Heard both sides and perused the material available on record. At the time of arguments, both the counsel submitted that C.C.No.2320 of 2013 is pending on the file of XI Metropolitan Magistrate Court at Miyapur and DVCA No.400 of 2015 is pending on the file of the Court of Metropolitan Sessions Judge, Ranga Reddy District at L.B. Nagar.

3 The learned counsel for the petitioner submitted that at present the petitioner is prosecuting her higher studies at Chennai. Both the counsel submitted that the O.P. may be continued on the file of the Family Court, Ranga Reddy District at L.B. Nagar. The learned counsel for the petitioner submitted that the presence of the petitioner before the Family Court, Ranga Reddy District at L.B.Nagar may be dispensed with for each and every date of adjournment. 4 Having regard to the facts and circumstances of the case, I am of the considered view that even if the presence of the petitioner before the Family Court, Ranga Reddy District at L.B.Nagar is dispensed with, the same may not

cause prejudice to her.

Accordingly, the Tr.CMP is disposed of. The presence of the petitioner before the Family Court, Ranga Reddy District at L.B.Nagar is dispensed with on each and every date of adjournment. However, the petitioner shall appear before the Family Court, Ranga Reddy District at L.B.Nagar as and when her presence is so required. Consequently, miscellaneous petition if any pending in this Tr.CMP shall stand closed.
