Heard learned counsel for the parties.

This Civil Revision Petition is directed against the order, dated 14.11.2013, passed on I.A.No.293 of 2013 in I.A.No.63 of 2013 in O.S.No.531 of 2001 on the file of XI Additional Chief Judge, City Civil Court, Hyderabad, filed by the petitioner. The I.A. was filed under Order XIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure, 1908 (CPC) for production of G.Shivender Reddy for cross-examination. That I.A. was dismissed in limine, vide order, dated 20.08.2013, holding that since there is no chief-examination affidavit of Mr.G.Shivender Reddy, which is wrongly typed as 'G.Rajender Reddy' in the order, the question of his cross-examination would not arise.

It is not in dispute that G.Shivender Reddy has not filed affidavit of examination-inchief, nor has he cited himself as a witness in the case till today. In view thereof, the order passed by the Court below cannot be faulted. Hence, the Civil Revision Petition is dismissed.
