THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION NO.11050 OF 2015 ORDER:

1. Petitioner in this Writ Petition has questioned the proceedings in Rc.No.95/2014 - C dated 19.03.2015 of the third respondent attaching property, which she claims to be exclusively belonging to her, for recovery of certain amounts payable by her husband pursuant to a surcharge notice issued under Section 60 of the Andhra Pradesh Co-operative Societies Act, 1964.

2. The petitioner has submitted a representation dated 31.10.2015 to the third respondent stating that the property attached is her exclusive property and not the property of her husband.

3. Petitioner's counsel contends that no orders have been passed on the said representation by the third respondent.

4. Having regard to the said submission, the Writ Petition is disposed of directing the third respondent to consider the representation/objection dated 31.10.2015 submitted by the petitioner to the third respondent within a period of six (6) weeks from the date of receipt of a copy of this order. All contentions of both parties are left open.

There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
