HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT APPEAL No.187 of 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellants does not press this appeal on merits and seeks liberty to the appellants to take a remedy of civil suit for declaration and other appropriate relief. He further prays for an observation that for a period of four weeks, the contesting respondents shall not create any third party rights in the property. Mr.Ch.Dhanamjaya, learned counsel for respondent Nos.6 to 10, on the other hand, on instructions, submits that respondent Nos.6 to 10 have already alienated the property in dispute in favour of third parties. He further submits that if the appellants ask for, in writing, the names of the purchasers, they shall supply to the appellants. In view thereof, we dispose of this appeal by the following order:

"Writ appeal is disposed of as not pressed with liberty as prayed. It is open to the appellants to seek names of the purchasers of the property in writing. Respondent Nos.6 to 10 shall furnish the names within a period of two weeks from the date of receipt of written request from the appellants. All contentions of the parties on merits

are kept open."

With these observations, the writ appeal is disposed of as not pressed.

Consequently, miscellaneous petitions, if any, also stand disposed of.
