THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35243 OF 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction on the part of the respondent No.2 in not issuing the cheque to the petitioner towards acquisition towards compensation of his land in Sy.No.58/408 admeasuring Ac.3-06 gts situated at Village Baghayath, Ibrahimpatnam Mandal, Ibrahimpatnam, Ranga Reddy District as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondent No.2 to issue the cheque to the petitioner towards compensation amount and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." 2.

Case of the petitioner is that respondent No.2 is not paying the compensation to him even though he is entitled for the same; that even though the acquisition proceedings are not in dispute, in view of the dispute raised by respondent No.5 herein, respondent No.3 conducted enquiry and submitted a report informing that respondent No.5 is not in possession of the land in question and even after that, respondent No.2 is not paying the compensation amount to him.

Heard and perused the material available on record. 4.

Considering all the facts and circumstances of the case and the grievance of the petitioner, the petitioner is directed to give a representation to respondent No.2 on or before 30.3.2017

informing all the facts and on such representation being filed, respondent No.2 shall dispose of the same in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
