THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8853 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.2 and 3 in the event of their arrest in connection with Crime No.744 of 2022 on the file of Station House Officer, Vanasthalipuram Police Station, Rachakonda registered for the offences punishable under Sections 304-B and 498-A read with Section 34 of Indian Penal Code.

Heard the learned counsel for the petitioners/Accused Nos.2 and 3 and learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

The facts of the case are that, the petitioners are mother and sister of Accused No.1. Accused No.1 was married to the daughter of the de facto complainant in the year 2016 and thereafter they had children. For the past two years, Accused No.1 and these petitioners were demanding for additional dowry. The petitioners are allegedly supporting Accused No.1 in the said demand for dowry and unable

to bear the harassment, the wife of Accused No.1 committed suicide which was informed to the de facto complainant. 4.

The main allegation is that Accused No.1 was suspecting the character of the deceased and was abusing frequently in filthy language.

As seen from the remand report of Accused No.1, six witnesses were examined, apart from the investigation, conducted the scene of offence panchanama and also seizures were also effected pursuant to confession of Accused No.1. 6.

In view of the above, since the investigation is almost completed, these petitioners against whom there is an allegation of abetting Accused No.1 and there are no specific allegations attributed to these petitioners, they can be granted the relief of the anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 and 3 are granted anticipatory bail subject to the following conditions:

i) The petitioners/Accused Nos.2 and 3 are directed to surrender before the of Station House Officer, Vanasthalipuram Police Station, Rachakonda within ten (10) days from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.2 and 3 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any pending, shall stand closed. ____________ K.SURENDER,J Date: 19.10.2022 ns
