O R D E R
The 1st respondent herein is the daughter of the petitioner and she along with her brother filed a petition under Section 125 of Cr.P.C. against the petitioner seeking maintenance in M.C.No.47 of 2004 on the file Judicial Magistrate of First class Nandigama, Krishna District and the trial court by order dated 3.11.2006 awarded maintenance of Rs.2,000/- each to them and not being satisfied with the amount awarded, the 1st respondent filed a petition under Section 127(1) of Cr.P.C. seeking enhancement and when the said petition is pending consideration before the trial court, the petitioner filed the present petition under Section 482 of Cr.P.C. to quash the proceedings on the ground of maintainability.
The petition seeking enhancement is pending before the trial court and at this stage, I do not find any ground to entertain the present petition and the same is liable to be dismissed and accordingly dismissed. However, it is needless to observe that the petitioner is always at liberty to approach the competent court after disposal of the petition filed by 1st respondent under Section 127(1) of Cr.P.C. seeking enhancement of maintenance.
No costs.
