HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.155 of 2017 O R D E R :

The contention of petitioners is that the 3rd respondent is calling petitioners and compelling them to settle the issue with the 4th respondent on the basis of a referred complaint in CFR No.1728 of 2016. The further contention of petitioners is that respondents herein without registering the case compelling petitioners to settle the issue and also threatening petitioners that they will arrest petitioners. Heard the learned counsel for petitioners and the learned Assistant Government Pleader for Home and perused the material available on record. Considering the facts and circumstances of the case and also as this case is arising out of the complaint referred under Section 156(3) Cr.P.C., the respondent-police are directed not to arrest petitioners and proceed with the investigation, if any case is registered on the basis of CFR No.1728 of 2016. The petitioners are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating Agency.

Accordingly, the Writ Petition is disposed of. No Costs. Consequently, miscellaneous petitions pending in this petition, if any, shall stand closed.
