THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26435 of 2018 ORDER:

When the matter is taken up, it is submitted by the learned Standing Counsel for R.2-Municipal Corporation so also the learned Counsel for R.3, that the respondent-Municipal Corporation issued a notice, dated 16.07.2018, under Section 459 of the H.M.C.Act, 1955, calling for the objections from the petitioner herein.

On the other hand, it is submitted by the learned Counsel for the petitioner that no such notice has been received by the petitioner herein.

Today, a copy of the said notice is given to the learned Counsel for the petitioner. In view of the same and as the respondent-Corporation already called for the objections under the above said provision of Law, the Writ Petition is disposed of, keeping it open for the petitioner herein to file objections to the above said notice, within a pd of two weeks from the date of receipt of a copy of this Order. If any such objections are filed, the same be considered and pass appropriate Orders, strictly in accordance with law. Till then, the interim order made by this Court on 27.07.2018, shall continue to operate. It is also made clear that if any unforeseen incident takes place in the subject premises, the petitioner alone shall be held responsible for all civil and criminal consequences.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition, shall stand closed. There shall be no order as to costs.
