THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6309 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.2 and 3 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.6 of 2016 on the file of the III Additional Munsif Magistrate, Ongole.

Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 420, 506 IPC and Sections 3 r/w 56 of A.P. Chit Fund Act. It is alleged that A1 and A2 are doing chits business and they are not paying the amounts to the subscribers even though period of chit was completed. Further, it is alleged that A1 took money by executing promissory notes and thereafter, he issued IP notice. A1 purchased gold and some of the lands in the name of the 2nd petitioner. When the 2nd respondent and others demanded A1 and the petitioners for payment of amount, they refused to pay and they threatened them.

Considering the facts and circumstances of the case and the nature of the allegations made against the petitioners, this Court is not inclined to grant the relief sought by them.

At this stage, the learned Counsel for the petitioners prayed for dispensing with the presence of the petitioners before the trial Court. In view of the above submission, the presence of petitioners-A2 and A3 before the trial Court is dispensed with except on the date of framing of charges, if any; on the date of examination under Section 313 Cr.P.C. and on the date of pronouncement of judgment. The petitioners are directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently,
