THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10830 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.152 of 2023 on the file of Ghanpur Police Station, Jayshankar Bhupalpally District, registered for the offences under Sections 379, 409 and 420 r/w. 120-B of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The Divisional Engineer/Stores & Services filed a complaint with the Police alleging that when the material was verified, it was found that material worth Rs.82,39,903/- was missing. The said complaint was filed on 06.06.2023. The Police during the course of investigation found that this petitioner and several others were involved in commission of theft of the said material from the Godown premises of the Department. It was further found that this petitioner along with other accused have entered into criminal conspiracy to commit theft of the said property.

Learned counsel appearing for the petitioner would submit that the Police have taken the petitioner into custody and major part of the investigation is complete.

Since the major part of the investigation is complete and the details of the material are subject matter of records maintained by the Department, this Court deems it appropriate to grant the relief of regular bail to the petitioner, subject to following conditions:- i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties, for a like sum each to the satisfaction of Judicial Magistrate of First Class, Jayashankar Bhupalapally District.

ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer, everyday at 10:00 a.m., for a period of two weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
