ORDER:
This contempt case is filed alleging wilful disobedience of order, dated 30.08.2013, in W.P.No.24676 of 2013.
By the above-mentioned order, this Court has directed the respondents
herein to hold enquiry into the grievances of the petitioners and act in accordance with law for rectification of the entries in the record of rights, if it is found after enquiry that the same were subjected to tampering. This Court has stipulated three months' time from the date of receipt of the order for completing such exercise. Alleging that enquiry has not been completed and action is not taken as directed by this Court, the petitioners filed this contempt case.
Respondent No.2 filed a counter affidavit, wherein it is inter alia stated that immediately on receipt of the order of this Court, the respondents have examined the issues with reference to the records and that a Memo was issued on 16.11.2013 informing the petitioners that the jurisdiction for correction of entries lies with the Tahsildar only and that however after detailed examination of the order of this Court, respondent No.2 has issued notices and commenced enquiry. At the hearing, the learned Assistant Government Pleader for Revenue (TS), on instructions, submitted that respondent No.2 has completed the enquiry and passed an order on 11.06.2015.
In light of this subsequent development and the explanation offered by respondent No.2 for not adhering to the time limit stipulated by this Court, the contempt case is closed leaving the petitioners with liberty to avail appropriate remedy, if they feel aggrieved by the order passed by respondent No.2.
