HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.6403 of 2016 Order:
The defendants in a suit for injunction have come up with the present civil revision petition challenging an order passed by the Trial Court allowing an application filed by the plaintiff under Order VII, Rule 14(1) CPC to receive certain documents.
2. Heard Mr. Sai Gangadhar Chamarty, learned counsel for the petitioners.
3. As rightly observed by the Trial Court, the documents which the plaintiff wanted to file, were obtained subsequent to the filing of the suit. Therefore, there cannot be an impediment.
4. The real grievance of the petitioners is that there was no application for condonation of delay. But the very allowing of the application under Order VII, Rule 14(1) CPC would mean that the delay was condoned. No formal application is necessary. Hence, this civil revision petition is dismissed. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
