HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.43658 of 2016 ORDER:

Heard the learned counsel for the petitioners, learned Government Pleader for Revenue, appearing for the respondent Nos.1 to 4 and Sri P.Ramesh Babu, learned counsel for respondent Nos.5 to 21.

It is admitted by all the learned counsel that the interim order has been passed by 4th respondent without serving any notice on the petitioners whose names had already been existing in the revenue records prior to the passing of the impugned order. 3.

Therefore, the impugned order is set aside on the ground that it is passed in violation of principles of natural justice. The matter is remitted back to the 4th respondent who shall issue notices to the petitioners at the following addresses viz.,

1. A.Sivarajulu, S/o.Veerappa, aged 70 years, Occ:

Agriculture, R/o.Teachers Colony, Wanaparthy village and District.

2. A.Shivasankar, S/o.Ramalingam, aged 44 years, occ: Agriculture, R/o.5-120, Budhanagar, Pirjadiguda, Ghatkesar, Ranga Reddy District.

3. A.Rajeshwar Lingam, S/o.Ramalingam, aged 39 years, Occ:

Business R/o.7-54/4/2, Balasaraswaty Nagar, Malkajgiri, Hyderabad.

MSR,J W.P.No.43658 of 2016 and to the respondents afresh and then after receiving their explanations, fix the date of hearing. He shall also pass reasoned order and communicate the same to the petitioners as well as respondent Nos. 5to 21. This exercise shall be completed within three months from the date of receipt of a copy of this order. Till then, status quo prevailing prior to 29-10-2015 shall be maintained in all respects.

Accordingly, the Writ Petition is allowed. No costs. 5.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
