notice, bearing No.e182116/ Advt./ GHMC/ 2018/ 419, dated 18.07.2018, issued by the Additional Commissioner (Advt.), GHMC/ respondent No.3 asking the petitioner to pay a sum of Rs.2,20,59,244/ - for allegedly displaying excess size of advertisements is challenged in the present Writ Petition. The principal contention advanced by the learned Counsel for the petitioner is that without being preceded by any notice and without giving any opportunity to the petitioner, the impugned notice came to be issued and the same is violative of principles of natural justice.
Today, when the matter is taken up, it is submitted by Sri L.Venkateshwar Rao, learned Standing Counsel for respondentCorporation that he has instructions to submit that the impugned notice can be treated as a show cause notice and it is open for the petitioner to submit an explanation to the same and if any such explanation is submitted, the same will be verified and appropriate further orders will be passed, strictly in accordance with law.
Recording the said submissions, the Writ Petition is disposed of, by directing the impugned notice to be treated as a show cause notice and the petitioner is directed to file appropriate explanation to the same within a period of three weeks from the date of receipt of a copy of this Order and if any such explanation is submitted by the petitioner, within the time stipulated above, the respondents shall verify the same and pass
final orders, strictly in accordance with law. Till the final orders are passed, no coercive action shall be taken against the petitioner herein.
Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
