THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5598 OF 2016 ORDER:
This Writ Petition, filed under Article 226 of the Constitution of India, challenges the order issued by the 3rd respondent - Chief Executive Officer, Prakasam District Cooperative Central Bank Limited, Ongole, Prakasam District, vide proceedings RMC/File No.1/2015-16, dated 19.08.2015.
2. Heard Sri Syed Ari Basha, learned counsel, appearing for the petitioner and Learned Government Pleader for Cooperation.
3. By virtue of the impugned order, the 3rd respondent inflicted the punishment of reduction of pay scales of the petitioner to minimum level. The material available on record discloses that the petitioner herein filed appeal against the said order of punishment on 28.08.2015 before the 2nd respondent - Chairman of the Prakasam District Cooperative Central Bank Limited.
4. According to learned counsel for the petitioner, the said appeal is pending consideration before the 2nd respondent and no orders have been passed on the said appeal. Though a number of contentions have been urged in the present writ petition, in view of the pendency of the said appeal, this Court is not inclined to go into the same. But, however, this Court is of the considered opinion that the ends of justice would be met, if the 2nd respondent- Chairman is directed to dispose of the appeal dated 28.08.2015 filed by the petitioner against the impugned proceedings dated 19.08.2015 by fixing some timeframe.
5. For the aforesaid reasons, Writ Petition is disposed of, directing the 2nd respondent to pass orders on the appeal dated 28.08.2015
said to have been filed by the petitioner against the order of punishment vide proceedings RMC/File No.1/2015-16, dated 19.08.2015, within a period of two months from the date of receipt of a copy of this order.
6. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 02.03.2016 SS
