HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27915 OF 2017 ORDER:

This writ petition is filed challenging the action of the respondent No.2 in not granting subsistence allowance, Dearness Allowance, City Compensatory Allowance, House Rent Allowance and Medical Facility to the petitioner since March, 2017. The petitioner was suspended from service pending disciplinary proceedings on the ground of his unauthorized absent to duty.

Learned counsel for the petitioner submits that as on today, enquiry is not completed.

Learned Assistant Government Pleader for Services submits that petitioner is only entitled for subsistence allowance during suspension period as per Rules, but not other allowances.

In view of the same, writ petition is disposed of directing the 2nd respondent to pay subsistence allowance to the petitioner, in accordance with Rules. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand dismissed.
