HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.26519 of 2018 ORDER:

The grievance of the petitioners is that the 4th respondent filed a suit in O.S.No.289 of 2018 on the file of Additional Junior Civil Judge's Court, Malkajgiri, Ranga Reddy District against the petitioners and another, wherein I.A.No.335 of 2018 was filed for temporary injunction and the same was dismissed on 06-07-2018. Inspite of the same, the respondent-police are interfering with the possession of the petitioners over the subject property and threatening them to settle the disputes.

Learned Assistant Government Pleader for Home produced written instructions stating that on the complaint made by the 4th respondent, a case in Cr.No.282 of 2018 was registered on 27-07-2018 against the petitioners. During investigation, the complaint and other witnesses were examined and their statements were recorded and the investigation is under progress. It is further stated that except registration of crime, the respondent-police never interfered with the civil disputes between the petitioners and the 4th respondent and a notice under Section 41-A Cr.P.C. was issued to the accused including the petitioners herein. Recording the same, the writ petition is disposed of. However, the respondent-police shall not interfere with the civil disputes between the petitioners and the 4th respondent.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 30-07-2018 Nvl
