HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 3772 OF 2017 ORDER:

This writ petition is filed for the following relief: "... to issue writ/order or direction more particularly one in the nature of writ of mandamus by declaring the notice No.03/GPR/2016, dated 07.11.2016, issued by respondent No.1, as illegal, arbitrary and violative of principles of natural justice and without disposing the representation and LRS applications direct the respondents not to interfere in the layout in Sy.Nos.2, 3, 5, 6, 7, & 8 of Raigir village, Bhongir Mandal, Nalgonda District."

Heard Sri Pasham Keishna Reddy, learned counsel for the petitioners, learned Government Pleader for Panchayat Raj for respondent Nos.1 and 3, Sri G.Narender Reddy for respondent No.2 and Sri V. Narasimha Goud for respondent No.5.

The Gram Panchayat, Raigir, 2nd respondent, vide notice, dated 07.11.2016, directed the petitioners to submit necessary papers in its office alleging that the 2nd petitioner is doing the layout development without showing any documents. In response to the said notice, petitioners submitted representation on 10.12.2016.

The main grievance of the petitioners is that without passing any orders on the said representation, dated 10.12.2016, the respondents are interfering with their possession and enjoyment of the subject property. At the hearing, learned Standing counsel for the Gram Panchayat submits that the Gram Panchayat will take appropriate action on the said representation, dated 10.12.2016, in accordance with law. Recording the said submission, the writ petition is disposed of directing respondent No.2 to take appropriate action on the petitioners' representation, dated 10.12.2016, within a period of two weeks from the date of receipt of a copy of this order. It is made clear that pending

consideration of the said representation, status quo as on today with regard to the subject property shall be maintained.

Miscellaneous petitions, if any, shall also stand disposed of. No order as to costs.
