Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent at the instance of the 3rd respondent in canceling the allotment of seat for the petitioner in National Institute of Technology, Warangal vide Proceedings dated 11.07.
2015 is illegal, arbitrary highhanded and violative of provisions of The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and Rules made there under and also the guidelines issued in G.O.Ms.NO.31(Women Development, Child Welfare & Disabled Welfare (DW), dated 01.12.2009 and consequently direct the respondents 1 and 2 to allot the seat to the petitioner in National Institute of Technology, Warangal and admit.
WPMP No. 28370 OF 2015 Petition under Section 151 of C.P.C., praying that in the circumstances stated in the circumstances stated in the affidavit filed in the Writ Petition the High Court may be pleased to suspend the proceedings of the 2nd respondent dated: 11-072015 issued canceling the seat of the petitioner allotted in CRL-PWD quota in National Institute of Technology, Warangal for four years course of Computer Sciences and Engineering to facilitate the petitioner to participate in the counseling process pending disposal of the W.P. No. 22015 of 2015 on the file of the High Court;
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of Sri Y. V. Anil Kumar, Advocate for the Petitioner and Sri Akka Venkataramana, Advocate for the Respondents 2 & 3, the Court made the following ORDER:
"Learned counsel for the second respondent seeks time to get instructions.
Post the matter after two weeks.
