CVNR, J & TA, J CMA.No.770 of 2017 Dt: 29.11.2018 Judgment: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal (CMA) is filed against Order and Decree, dated 16-07-2014, in OP.No.45 of 2013 on the file of the Senior Civil Judge at Suryapet, whereby he has decreed the said OP filed by the respondent for dissolution of his marriage with the appellant.

On 22-11-2018, both the parties were personally present. Both of them have arrived at an understanding, as per which, the respondent agreed to pay a sum of Rs.8,50,000/- towards full and final settlement of all the claims of the appellant as per Ex.A.1 in two instalments and that the first instalment will be paid today and the second instalment would be paid within three months thereafter.

Both the parties are personally present today also. As undertaken by the respondent, he has produced Demand Draft bearing No.710194, dated 27-11-2018, drawn on Andhra Pradesh Grameena Vikas Bank, Suryapet Branch, for a sum of Rs.4,25,000/- in favour of the appellant and handed over the same to the appellant.

Mr.Mummaneni Srinivasa Rao, learned Counsel for the appellant, submitted that as the respondent has paid 50% of the amount and agreed to pay the balance amount within three months, the CMA may be dismissed, however, with liberty to the

CVNR, J & TA, J CMA.No.770 of 2017 Dt: 29.11.2018 appellant to seek revival of the appeal, in the event the respondent fails to pay the balance amount within three months. The respondent has undertaken to hand over the Demand Draft for the balance amount to his Counsel- Mr.Bommagani Prabhakar, who, in turn, agreed to hand over the same to Mr.Mummaneni Srinivasa Rao, learned Counsel for the appellant, for being eventually handed over to the appellant.

In view of the above submission of the learned Counsel for the appellant, the CMA is dismissed.
