ORDER:

The petitioner is a Senior Mate. On several allegations, disciplinary action was initiated against the petitioner, which resulted in imposing the punishment of removal by order, dated 31.07.2015. Aggrieved thereby, the petitioner preferred appeal to the Commissioner of Rural Development on 03.08.2015. Alleging that so far this appeal is not disposed of, this writ petition is filed challenging the order of removal from service.

2. As per the Human Resources Policy, against an order of the Project Director, initially the District Collector was made competent authority. However, subsequently, the jurisdiction of appeal provision was vested in the Commissioner from 24.07.2015 till October, 2015. The petitioner preferred appeal during the period when the Commissioner was the appellate authority. This appeal is pending consideration of the Commissioner.

3. Having regard to the same, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Commissioner, Mahathma Gandhi National Rural Employment Guarantee Scheme, Hyderabad (2nd respondent) to pass orders on the appeal filed by the petitioner on 03.08.2015, as expeditiously as possible, preferably within a period of eight (8) weeks from the date

of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
