Crl.Petition No.8863 of 2022 THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 8863 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal procedure, 1973 seeking pre-arrest bail to the petitioner/Accused in the event of her arrest in COR No.206 of 2016 dated 29.09.2016 on the file of Station House Officer, Excise Police Station, Alampur of Jogulamba Gadwal District, registered for the offence punishable under Section 34(a) of Andhra Pradesh Excise Act, 1968. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.

The petitioner is arrayed as an accused in the crime that was detected by Gadwal ESTF, Alampur of Jogulamba Gadwal District. The petitioner allegedly ran away from the place where toddy was seized. The sample was sent for FSL and found that Alprazomal was mixed with the said toddy.

Since the offence is of the year 2016 and considering that the petitioner being a woman and aged about 58 years, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused shall be enlarged on bail in the event of her arrest subject to the following conditions:

i) The petitioner/Accused is directed to surrender before the Station House Officer, Excise Police Station, Alampur of Jogulamba Gadwal District, within ten (10) days from today, and on such surrender, she shall be enlarged on bail on her executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) On such release, the petitioner/Accused shall appear before the concerned Station House Officer as and when required. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
