HON'BLE SMT. JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION No.12493 of 2024 ORDER :

Petitioner/accused No.2 has filed this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, seeking anticipatory bail in Cr.No.291 of 2024 of P.S.Chikkadpally, registered for the offences under Sections 109, 127(2), 118(2), 49, 61(2) r/w.3(5) of Bharatiya Nyaya Sanhita. 2.

Heard Smt. P. Vijaya Lakshmi, learned counsel for petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the State and perused the record. 3.

The case of the prosecution is that the petitioner and other accused have beat the complainant with sticks and rods in an attempt to kill him.

Learned counsel for petitioner submits that the petitioner herein has nothing to do with the alleged offence and he has been falsely implicated in the case. It is further submitted that this Court by order dated 16.10.2024 in Crl.P.No.12395 of 2024, has stayed all further proceedings against accused No.1 including his arrest. Further, accused Nos.3 to 6 were granted regular bail vide

order dated 26.09.2024 in Crl.P.No.11223 of 2024. Accordingly, he prayed to allow this petition also by granting anticipatory bail to the petitioner/accused No.2.

Though the learned Additional Public Prosecutor has opposed the application, since relief was granted to the other accused in the crime i.e. accused Nos.1 and 3 to 6 and as the petitioner/accused No.2 also stands on the same footing, this petition is allowed granting anticipatory bail to the petitioner subject to the following conditions:

1. The petitioner/accused No.2 shall surrender before the Station House Officer of P.S.Chikkadpally, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.20,000/- with two sureties, for the like sum each.

2. The petitioner/accused No.2 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
