THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38732 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the respondents 1 to 5, more particularly, the 5th respondent in not registering FIR against the respondents 6 and 7 in pursuance of the petitioners complaint, dated 05.11.2016, as arbitrary and illegal and consequently direct the 5th respondent to register FIR against the respondents 6 and 7 on the complaint of the petitioner, dated 05.11.2016.

Heard and perused the material available on record. The main grievance of the petitioner is that the Station House Officer, Falaknuma Police Station, Hyderabad - 5th respondent, is not registering a case against the respondents 6 and 7 basing on the complaint lodged by the petitioner dated 05.11.2016.

Considering the grievance of the petitioner, the 5th respondent is directed to register a case against the respondents 6 & 7 if the complaint lodged by the petitioner dated 05.11.2016 discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 5th respondent, he is at liberty to approach the superior officer of the 5th respondent and also to approach the concerned Court by invoking provision under Section 200 Cr.P.C.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 10, 2016.
