THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.5978 of 2009 ORDER:

This writ petition was filed for the following relief: "to issue an order or writ one in the nature of Writ of Mandamus declaring the action of respondent No.1 in not considering the petitioner's representation dated 13.03.2009 for grant of instalments for payment of the balance lease amount, in respect of reach Nos.8 and 9, Penumudi and Morthota Villages, Guntur District, pursuant to order of respondent No.2 made in Letter No.985/SAND/2009(R-8&9) dated 18.03.2009 as arbitrary, illegal, unjust, discriminatory, violative of the A.P. Minor Mineral Concession Rules, 1966, violative of the fundamental rights guaranteed to the petitioner under Articles 14 and 19 of the Constitution of India and consequently direct respondent No.1 to consider his case by way of granting instalments."

On 20.03.2009, this Court passed an interim order directing respondent No.1 to consider the representation dated 13.03.2009, purported to have been submitted by the petitioner, in terms of Rule 9K of the A.P. Minor Mineral Concession Rules, 1966 and pass appropriate orders as per law within a period of two weeks from the date of receipt of a copy of the order and communicate the same to the petitioner.

It is represented by the learned counsel for petitioner that the period of lease was completed and hence, nothing survives for consideration in this writ petition.

Recording the said submission, this Writ Petition is dismissed as infructuous. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed. ________________________________ A.RAMALINGESWARA RAO, J 13.04.2016 MVA
