THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.5289 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner in C.C.No.1294 of 2015 on the file of the Court of the III Additional Chief Metropolitan Magistrate Hyderabad.

The learned counsel for the petitioner seeks permission of the Court to permit the petitioner to withdraw the Criminal Petition, with liberty to avail the remedies available to him under law. He further seeks the permission of this Court to permit the petitioner to file a petition under Section 205 Cr.P.C. before the trial Court. Permission is accorded.

In the result, this Criminal Petition is dismissed as withdrawn, granting the liberty as prayed for. In the event of the petitioner filing petition under Section 205 Cr.P.C, the trial Court is hereby directed to dispose of the same in accordance with law.
