THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5631 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1, 2 and 7 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.37 of 2014 on the file of Yaddanapudi Police Station, registered for the offence punishable under Sections 323, 354 r/w 34 IPC and Section 3 (1)(r)(s) of SCs & STs (POA) Act. Heard and perused the material available on record. It is alleged that on 22.7.2014 when the 2nd respondent procured water to deliver at Ramalayam Vari temple and went with a tanker to the temple, the petitioners abused him in the name of his caste and they beat him with legs and hands. When his mother intervened, she was pushed away and her jacket was torn. Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by them.

However, the petitioners are directed to surrender before the Station House Officer concerned. On such surrender, they shall be released on bail on each of them executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum each to the satisfaction of the Station House Officer concerned. The police concerned are directed to complete the investigation, without arresting the petitioners. In the event of necessity, the police concerned are directed to issue notice to the petitioners to appear before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioners are directed to appear before the investigating agency and give an undertaking as to their future appearance as and when required for the purpose of investigation.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
