THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.22187 of 2005 ORDER:
This writ petition was filed to declare Act No.1 of 2005 as illegal and to consequently declare that G.O.Ms.No.330 dated 10.08.1993 was valid and applicable to the petitioner.
The petitioner was upgraded as a Grade-I Language Pandit under G.O.Ms.No.330 dated 10.08.1983. However, this up-gradation was sought to be nullified by virtue of the impugned enactment.
By order dated 07.10.2005, this Court opined that the question as to whether the up-gradation of the petitioner as a Grade-I Telugu Pandit could be set at naught pursuant to Act No.1 of 2005 needed to be considered and accordingly granted interim stay as prayed for.
The petitioner was aged 56 years at the time of institution of this writ petition. He would therefore have retired from service long ago upon attaining the age of superannuation. As his up-gradation as a Grade-I Telugu Pandit was not withdrawn by virtue of the interim order passed by this Court and as he retired from service in that capacity, no steps can be taken at this late point of time to set at naught such up-gradation.
Making this position clear, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
